Terms of Service
These terms govern your use of the Landscaping Outlook website and design tool (the "Service"). By using the Service you agree to them.
1. What the Service is
Landscaping Outlook generates AI-rendered concept images of landscapes and gardens based on inputs you provide (text prompts, descriptions, and optionally uploaded photos). Outputs are conceptual visualisations, not engineering drawings, surveys, council-approved plans, or guarantees of feasibility.
2. Your responsibilities
- Only upload photos you own or have permission to use.
- Don't use the Service to generate content that is unlawful, defamatory, sexually explicit, deceptive, or that infringes someone else's rights.
- Don't attempt to overload, scrape, or reverse-engineer the Service.
- If you're acting on behalf of a business, you confirm you have the authority to bind that business to these terms.
3. Rendered output and IP
You retain ownership of the prompts and photos you submit. Subject to your compliance with these terms, you may use the renders we generate for you for any lawful personal or commercial purpose. Note that AI-generated images may not be eligible for copyright protection in some jurisdictions.
4. Lead matching
When you submit a lead, we share your contact details and render with vetted local landscapers, designers or builders so they can quote you. We do not guarantee any specific outcome, response time, work quality, or fitness for purpose of any third-party trade. Any agreement you reach with a trade is between you and them.
5. Paid plans
Paid plans (when available) are billed in Australian dollars, including GST where applicable. Subscriptions auto-renew until cancelled. You can cancel at any time; cancellations take effect at the end of the current billing period. Render credits are non-refundable once used.
6. Service availability
We aim for high uptime but make no guarantees. The Service may be unavailable for maintenance, updates, or due to upstream provider outages.
7. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or relating to your use of the Service is limited to the amount you have paid us in the 12 months preceding the claim, or A$100 if you haven't paid us anything. We're not liable for indirect, incidental, consequential or special damages.
8. Consumer guarantees
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded.
9. Termination
We may suspend or terminate your access if you breach these terms. You can stop using the Service at any time.
10. Governing law
These terms are governed by the laws of New South Wales, Australia. Disputes will be resolved in the courts of New South Wales.
11. Changes
We may update these terms. Material changes will be announced on the homepage at least 14 days before they take effect.
